A woman from the Midlands has received £12,000 in an out of court settlement after her dentist provided an implant retained denture which was deemed to be of an unacceptable standard.

The Dental Law Partnership was instrumental in recovering compensation for their client after she approached them for legal assistance with her dental negligence claim.

The woman, a keen flautist, had visited her dentist to discuss options to make the denture in her lower jaw more permanent. She informed the defendant that her flute playing exerted pressure on her lower teeth, but the dental professional planned a course of treatment which involved fitting dentures over implants to replace 4 of the client’s bottom teeth.

The procedure was carried out in September 2008, but just five days later the implants replacing two of her bottom teeth had fallen out. Over the course of the next year, the client revisited her dentist for corrective procedures on two separate occasions until taking the decision to seek the advice of another dentist. She chose to seek outside help since she was no longer able to play her flute and was also experiencing speech problems and difficulty in eating.

X-Rays revealed that the woman had lost bone around two of the implant fixtures and the denture was poorly fitted.

The second dentist referred the client to a specialist for extensive corrective procedures in March 2010. This included removal of the denture and the installation of new implants in the bottom jaw.

The Dental Law Partnership client is still unable to play the flute to the same standard as before the original incident, but is pleased with the damages that the firm were able to help her to claim. Her dentist did not admit liability for dental negligence.
