March 13, 2024 - Celeste M. Butera, Partner, Hoffmann & Baron, LLP, was a recent guest on the ‘IP Fridays Podcast’.
In an interview with Host Kenneth Suzan, Butera discussed the realities of cybersquatting and the challenges of pursuing and enforcing remedies for trademark infringement that is committed on the internet.
In the new wave of technology, Ms. Butera explained, “The problem is that now infringers, as well as consumers, are worldwide and there are personal jurisdiction issues.” She further discussed the conundrum that online infringement poses and how the disparity in legal systems creates further complications when pursuing legal action.
Ms. Butera continued by outlining the steps involved in resolving a cybersquatting and/or trademark infringement complaint and the appropriate course of action. In choosing which remedy to pursue, how to present your case, and ultimately how to seek final forms of service under each of the relevant statutory provisions, she counsels businesses to "be creative." She stresses the value of applying imagination to the laborious process and making the right moves.
